I wonder how DOL is interpreting the "new employment" clause in the new law that prevents TARP companies from sponsoring H1Bs. Technically, an LCA filed for an H1B extension is for a "period of new employment". If they were to strictly follow this technicality, H1B extensions by TARP companies would also be unlawful. However, from the employer's perspective, an H1B extension is not a new employment, but a continuation of an existing one.
Have any of the celebrity immigration lawyers published their interpretation yet?

Hi folks,
I am on H1B visa currently, set to expire in two months from now (end of September). I need to get my H1B renewed for the next 3 yrs. Due to unavoidable reasons my lawyer has not been able to file for the renewal yet.
My questions are -
1. Do I need to have the approval notice before my expiration date?
2. I plan to travel internationally in November. Would the receipt notice be acceptable to reenter? Or do I need the approval notice?
Any suggestions are most welcome. Thanks in advance.

If you really don't want to use the DataGrid, you could just use a ListBox. Each ListBoxItem (you can edit the ItemsTemplate) could be a textbox with a series of comboboxes inside it. That will give your users the illusion of having a scrolling list of items that they can enter values into.

My wife had concived for 3 days in June. During immigration medical exams Doctor gave her MMR shots and stated don't get pregnant for another 3 months.
After 15 days, We came to know that she is pregnant.
last week my wife had miscarriage after 18 weeks of pregnancy. Not sure it's because of MMR or something else.

According to this document, if you switch jobs it IS better to file the AC21 and inform the USCIS, just in case trhe employer decides to reovke the I-140.

I have I129 document (Petition for Nonimmigrant worker) which was valid from 10/01/07 to 09/24/2010. However i never used it. As My husband is working in US on H1b visa, i am now looking for job in US. Can you please let me know if this I129 can be used or not. I would highly appreciate early response.

Hi folks,
My baddest of the bad phases started recently when I lost my wife's birth certificate from India. Worst part is we dont have backup (no photo copies of it).
Anyways, We are waiting in the 485 queue, working on EADs. Question to all folks, do still need birth certificate now for the green card process, as we have already sent the application?
And how bad it is with redtape/corruption in India, to get another birth certificate from my wife's birth hospital, when we try by ourselves (I mean not involving our/her parents), when we visit India next time (maybe for a month)?
Appreciate your responses..

HI All,
My H1 will expire by the end of October and my employer has applied for LCA on First week of Sept and it got denied. (the status on iCert shows as Denied). My employer has sent the FEIN Info and waiting for info from DOL.
I am not sure how long we will wait for DOL to respond back on this .. Do we need to reapply for LCS as i need to apply for H1-extn before end of October..
Could Pls some one suggest the best course of action..

Whether it is Department of Homeland Security (DHS) policy or not, I do not know, but last week, I noticed DHS personnel roaming through the terminals at Dulles International Airport in Washington, DC. They actually went to various gates and randomly requested ID or passports from OUTBOUND passengers seated in the boarding areas.
That is, they checked the documents of both Americans and foreigners who were LEAVING the USA. Not entering.
I followed them around a little bit. The officers were friendly, civil. They approached passengers in the terminal, asked them their final destinations, and asked if they could see their passports. Interestingly, although I was standing right next to a bank of chairs in the boarding area, they did not ask me for my passport, nor did they ask anyone who was standing or walking through the terminal. They only approached persons seated in the departure gate area. I did not see them detain anyone.

1. "What is Date for Application?" - is the "Received Date" in my EAD receipt?
2. "Manner of Last Entry" : I put H1B - Speciality Occupation. Hope that is fine as I entered last year using H1B (am on H1B and there was one more H1 option there)
3. Current Immigration Status - "I put H1B - Speciality Occupation".
4. Eligibility Status - "I485 filed" - is that right? Am a July 07 filer.

Currently, I am on H4 visa. Recently, I was offered employment and got my H1B approved.
But, my new I797 approval notice does not contain I-94 part.
Do we need to apply for Change of Status from H4 to H1B now while I remain in US? Do I need to do it or my employer needs to do it?

Hi,
First my 140 was filed in first week of april and got receipt notice with received date as 11-Apr-08, and in May it was rejected because of check bounce issue.
Again my 140 was refiled in july,and got my 140 receipt notice with received date as 24-Jul-08.
(My labour was approved on 23-Jan-08 and its expiration date is 21-Jul-08,
i think there is rule that 140 should be filed before 180 days of labour approval)
My lawyer is saying:
we first filed it well before the dates,so you should not have a problem, as this is refiled in follow up to the original one.
I am still wondering the USCIS will process my 140.

This is a simple and straightforward case.
Rules are: You are allowed to change the company but you should be in "same or similar" position.
Your new company will have to agree to continue to support the existing green card process i.e. they may have to give employment verification letter if and when asked by USCIS..
All in all I think you are in the safe..
