Agree on the eye, it's important to see that, and have a little catchlight for making the animal look alive. Only problem with the first shot is the branch behind the head. It's blurred a bit which helps though. The background is difficult to control - you take what you get many times with animals and birds.

Dear Lawyers,
I am a registered professional civil engineer in the state of PA having an educational background of a BS from India and MS from the US in civil engineering. I got my H1B extension approved last year for its second term of three years. I have been working in the same company since my graduation and also hold an approved I-140. I am planning to visit India in March to get my visa stamping done and am concerned about the reports of valid H1B holders being returned from Newark. Do you think I should avoid Newark as the PoE?

I am currently residing in US on H-4 visa. My husband is on H-1 visa and our Green Card processing is in progress - our
I-140 has been approved. Our priority date is in May 2008.
The current "priority dates" for EB-3 as per USCIS is April-2001. Based on this, When can we expect our "485" to be filed and our EAD to be approved ?
I have a law degree from India (12+3+3) and currently I am pursuing a paralegal program from an ABA approved university. I might loose my job oppurtunities if I don't have a work permit. Is there anyway that I can get a work permit with my pending GC application process, without hampering the GC process ? Can I get a work visa (or EAD) based on my education ?

With a priority date of May 2008 EB3-India, unless there are legislative changes (or another July 07 fiasco) you are expecting a wait of atleast 4-5 years before you can file your 485 and get an EAD. Perhaps longer, considering how EB3 is ~8 years backlogged.
Your best bet would be get H1-B sponsorship.

Th I-140 is not revoked yet, but the original company that filed it is going to split in to 2 separate companies by the end of the year and I think I-140 will become invalid after that right if the original company doesnt exist anymore??
You can still claim the PD of your old I-140. Once an I-140 is approved PD is yours to keep for life.

can you post the numbers for CY-2006 and CY-2007 for India and China.

My wife's I-797A got lost in transit mail. I was wondering is there a way to order a replacement I-797A and how long would it take to get one. I need to take it to the SSN office as they require original documents to issue a SSN card. Your help is much appreciated!

In the I-140, Immigration Petition for Alien Worker, under �Basic information about proposed employment�, in the �Wages per week� column it is written as $XX,XXX/yr.
Is this the amount my employer offered in the full time position that he offered while processing my GC?
Do I have to make sure my salary with new employer should be more than $XX,XXX/yr?
Also my original employer who filed my GC mentioned my designation as Software Engineer � Applications, Do I need to have same designation in the new firm? Or can it be anything under Software Engineering like design, programming, analysis,developer,data quality,testing etc?

My LC and I-140 was approved with my ex-employer in CA.Now I have a oppurtunity to join my ex-employer in the east coast. Will I be able to file AOS if I join in a similar role and when my PD becomes current ? The immigration lawyer of my ex-employer told me that I have to join in the same location as my LC was approved to take advantage of AOS as it is location specific. Is it true?

I am in a interesting situation. I have an approved EB2 I-140 but I recently applied for EB1-140 and I-485 concurrently and they are pending. Given that all PDs are now current, is it possible to convert my I-485 to the approved EB2 I-140. This will remove the uncertainty around approval of EB1 I-140. Any advice/experience is appreciated.
You can apply of AOS i.e I 485 only for one application . Since you already have applied for AOS on EB1 I highly doubt u can apply for AOS for EB2. Talk to your lawyer and find out

I moved to US in 1987 got a 2 year conditional residence green card sponsored by my step father. Once the 2 years were met the new forms were submitted but I believe were a couple of days late. At the time I was 19. I remember vaguely remember it but we took the paperwork into the office.
So I waited and waited at an address shared with 2 college roommates and no new green card came. I thought maybe it came and someone had mistakenly through it away. No notice was sent to my mother's house for me to leave.
Well I never really bothered with it till more recently. I didn't work I had ID so other than violating the fact I didn't "carry" my green card everywhere I went, I thought i was perfectly legal.
In 1993 my mother passed away(still married to stepfather).
So about six months ago I decided to file an I-90 for a new card because I wanted to travel out of the US. They sent me an appointment for biometrics. I went to that and figured it was a done deal. Then they sent me a card that expired in 1989, explaining that I had filed the wrong form and needed to file like the I-751. Also they let me know that they would keep the fees for the wrong filing(the least of my worries).
So I briefly looked over this I-751 and basically I think I have to prove that my mother was married to my stepfather for the required time. First I barely remember his name, have no idea where they were married. Just looking for some help on this situation. Not really sure what to do.
I have an appointment on Monday with an immigration attorney. They ran my alien number for me and no action of deportation has been started. So I guess that is a good sign.
I have been here almost 21 years now and I like it here I want to stay :P

I currently work for a consulting company who is sponsoring my GC.Our client has offered me a full time position and I was planning to use AC21 to switch over but better sense prevailed over me to continue with my current employer to avoid any issues in GC processing.Now my client is not willing to extend my contract.Given the current job market, I think it might take atleast a month or two for my employer to find me another project.
Just in case my I485 gets approved, can anyone please let me know if it is ok to be without pay (employer will not pay between projects) after the GC gets approved?Please advise.

On Acceptance, your petitioner will receive the hardcopy (receipt notice) generally within 2-4 business days.
Check on the receipt notice, the amount and a text which says its filed in premium.
