I think you should apply for H1 extensions about 6 months in advance even if u have applied for AOS. Your driver license might also expire with your H1-b and to renew your license you will need approved H1-Extension. Also just in case something goes wrong with your AOS application and it gets denied, you might be out of status.
I would strongly suggest that you apply for H1-Extension well in advance just to be on safe side.

HI all,

My husband was not given visa, VO never asked him any question and just stapled a paper to his passport to track his visa status online. I asked VO wheathre that means my husband was rejected, she said no just some delay, it takes some cases more time.
it has been one month since I did my interview in the consulate and nothing updated on that web site. My husband has his sister in USA with Green card. What do you think the situation will be? is it rejection or wil get visa later?

Dear Friends,
My employer got an RFE in regards my recent filing of H1b.
The RFE talks about the office space.
Currently my employer has 3 employees and the available space is for 3 people. One of them is an Account Manager and basically the Manager has adopted the HOT DESK philosophy; so, basically the current work space is ok to accommodate me.
Can you please help to answer this request?

One of my friend is in the same situation and he has been told by his lawyer that he can get his part-time concurrent H1 Extn for 3 years based on fulltime concurrent H1 approved I-140.
He is going to apply the same soon.

sorry to break it to you - but he's quitting a very happy man as every other rupublican is trying to 'out-tancredo tancredo' as he himself put it. he's done his job and poisoned the atmosphere which is all he wanted to do.
I disagree . He thought his immigration stance will take him to white house. He earlier announced that he will not run for congress again. Poison can be taken care of as long as you kill the snake so that it does not bite other people.

There is a change of status form available on USCIS website. It is called I-539:

Go through the instructions of this form. I followed the instructions in this form and sent every document they asked for. My wife also changed her status from F1 to H4. After you send everything, you will get a receipt in 2-3 weeks and approval notice will take ~3 months.

In normal circumstances (without the floodgates open) you would get a receipt within 2-3 weeks after the application is submitted. Fingerprinting happens soon after (still within a month). Then you get an EAD first, then the AP. In all this your lawyer will be informed as well as you. Sometimes your lawyer gets to hear first b4 you.

She has an H1 whch expires in 2012.
she used her AP while entering US this year at port of entry. Office gave I-94 for one year(it expires in Jan 2011).
Now my question is does she has to do anything to renew her I-94?
If she doesnt renew her H-1 now will she be still in-status on H1?
does she have to renew her AP in order to stay in status?
This area of the law is very confusing and it would be great if some attorney or expert give their valuable suggestions on this.

AP is only for travel purpose. She will be either on AOS or H1 Status.
If she wants to work, she needs to get either EAD or keep the H1 status. Since she used the AP upon return, she is now not in H1B status. Check with attorney if you want to restore to H1
