    When I went to my county health dept to get vaccination shots (for medical exam), they asked me to see the civil surgeon first, "else you will pay lot more for shots that you do not need". I gave them the standard list (MMR, Polio, DTaP, Influenza type B, Hepatitis B), and there are a few more in (page 3 of) I-693 form (http://www.uscis.gov/files/form/I-693.pdf). Someone on this thread (http://immigrationvoice.org/forum/showthread.php?t=5553) (second-last post) says you may need a shorter list based on your age group. Did anyone recently take these shots, and can she/he give the correct list here?

    I only took TDaP (Adacel) shot. For MMR, Hepatitis B and Chicken Pox I had a blood test which showed that I am immune. You do not need polio shot.

    Now working on H1b, 8th year
    PD: Oct 2005
    I 140: approved
    I 485: pending
    AP, EAD: approved

    I want to change job to another employer.Can the new employer file an H1b for me based on my approved I 140. I prefer to be on H1b as traveling is easier and don't have to wait for the EAD, AP each year and the uncertainities invloved.

    I would appreciate replies.

    Yes, new employer can file H1B transfer, but I donno the rule for 8th year ext.
    For AC21 you can always use H1B transfer or EAD.

    I don't believe leaving the company that you had signed an I-9 form with have any impact on your GC app as long as you have a same or a similar job lined up if and when you do get an RFE regarding the same.

    As mentioned several times, GC is for future employment and you can switch employers as many times as you want under AC21 (of course you don't want to go overboard with switching employers every few months either :)).

    I hope this helps - again this is my understanding of the law and not a legal opinion.

    Does the I9 form that we sign with our company have any impact on our 485 processing if we leave the company using AC21.

    One of my friend is ready to apply for 485. He is all set.

    The problem is he got recently married and his wife's passport and other details are not yet ready and she is still in India.

    Can he still submit his 485 for his wife?

    Gurus, any help / suggestions is appreciated.

    A 7th year extension is still possible, but the extension petition must be filed within 180 days of the LC approval. ( per current DOlL regulations, the LC expires after 180 days). My advice would be to have company B file to amend it's petition, requesting a validity date of 12/12.

    I had Mar 05 PD through RIR but lost it as i never applied for I140. 4 other guys from my company are in the same boat as mine...

    Current PD is Oct 05 through PERM...

    By the way i dont think we can ever find the count between Jan 05 - Mar 05 through this thread...Data from FOIA request would be more helpful

    Same boat. My brother's marriage is in the last week of August and I have to travel to India.

    When I go to India, I will need to get H1b stamping on extension - will that be an issue?

    If I apply for 485 now, and they send biometrics notices when I am in India (will be there for a week in last week of August) , will it be an issue? Though it is a long shot?

    Changing address - I will be moving into a new apartment soon (in 3 months) - so effectively after applying 485, I will be moving to a new apartment - how will I handle address change?

    Can anyone help me with these answers :)

    It is very possible that my question might have already been answered in the past but after searching through many forums, I could not find a direct answer.

    Here�s my situation:
    Category: EB2
    PERM approved.
    I 140 approved.
    PD � Dec 2007.
    H1-B status: 6 yrs expiring Sep 10. Filed for 3 yr extension.

    I have an excellent chance of a promotion to a managerial level position. I am seriously considering abandoning my current GC process, accept the managerial position and reapplying for a new H1-B and GC.

    Questions:
    1. Will I need a new H1-B? If so, for how many years will I get it?
    2. When I apply for a new PERM, will PD of Dec 2007 still be valid?

    The American Immigration Lawyers Association (AILA) has applauded the brainstorm of ideas in a draft memo from the United States Citizenship and Immigration Services (USCIS). The now-public draft, leaked without the permission of USCIS, examines the legal framework of immigration and explores possible solutions. AILA commends this reflection of the pursuit of the rule of law and the willingness of USCIS leadership to take up this thorough examination.

    "We have in the past seen many attempts to scour the law to find justification for draconian, and ultimately unhelpful, ways to make immigrants' lives miserable," said AILA president David Leopold. "This draft document tries to think through ways to make the legal immigration system work in support of sensible law enforcement. It respects the law and respects the people who must deal with the law. For that, the administration is to be congratulated, even if none of the proposals is ever carried out." He added that many of these proposals should be carried out. Long-needed regulations to help children and crime victims caught in the system should be published. Men and women fighting for America in the U.S. military should have the comfort of knowing that their families are safe from being deported. Immigration policies that encourage investment in America and creation of jobs should be emphasized and expanded. These are but a few of several excellent proposals in this document.

    "We will never effectively address illegal immigration until we develop a legal immigration system that actually works and that offers people a realistic alternative to illegality," added AILA Executive Director Crystal Williams. "Congress has thus far refused to act. Administration officials at least are trying to find ways to help fill this vacuum," Williams stated.
