Hello,
Can Team-IV go to USCIS as a group to ask them to clear the I140s pending quickly. This way, we can ask CIS to follow the FIFO rule.
If they can clear 100+K I129s in 6 months, Why can't they do the same for I140s??. I think there are about
135K pending I140s in CIS (Source immigration-law.com).
That would equate to 340K I485s pending. Even if I consider 10% as duplicates(No Source, just estimate), we will still get about 300K I1485s in the processing queue. This way, everybody will know which category is backlogged and plan accordingly.
As an Individual, we also will have one of the stage completed and be eligible for longer extension of stay etc.
Any suggestions???

I have US masters and 4+years of US job experience and My I-140 was filed in EB2 using a Substitution labor which as the education/experience requirements of (14) Masters+1years experience or (15) Bachelors + 3Years Experience and it was denied without RFE saying the Labor certification used is not suitable for EB2 as they say EB2 labor should be requiring "Masters or BS+5Years Exp", which makes sense.
My Attorney filed an MTR (I290B) on 03/11/2008 and requested the USCIS NSC center to re-consider my case as EB-3 instead as EB2.
Today 03/21/08 i just got an update from USCIS saying:
Current Status: Appeal/Motion/Certification sent to Administrative Appeals Office for review.
On March 21, 2008, we sent this case to the Administrative Appeals Office for review. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, call customer service.
1- So now what are the chances of my I-140 getting approved and how many days does the AAO take to make any decision on this?
2- And for my 485/EAD/AP/FP i did not get any message saying that they are denied and my wife is still working on her EAD on advice of the attorney and as the I-140 is with AAO can she still continue the same job until the decision is made on the I-140 and 485.
Please help me out and advice on what should i be doing at this point and what are my options on this.

Hello!
My H1B got expired in Sep 2010, ( applied for transfer before expiry), got RFE and finally approval last week, but 797 form has the validity from current date(approved date) instead of requested date in Sep 2010. So now is the period from sep 2010 to 797 approved date is considered as out of status or how it is? I have paystubs during this time and on job all the time. Any implications while going for h1b stamping in India and or at port of entry and in future GC.
Any inputs are apprciated. Thanks!

Now it has changed and says that a new letter (not the EAD card) has been mailed, but I won't get this letter till after Aug. 11th, my joining date. I do have a printout of the previous status, though.
2. I managed to get a letter from my university saying that my case has been approved.
3. I have the receipt notice, which shows that the case was submitted and received by USCIS.
My company still insisted that they would need a letter from USCIS saying that my case has been approved. Any advice on what I can do from here??

Man,
I am in a similar situation where Company B just filed for my extension based on approved I-140 from Company A. I have a 3 year extension thru Company A based on an approved I-140 petition from them. I hope my employer will not withdraw my I-140. FYI, I have not filed my I-485.
Now, what is the way out of your situation here? Can someone reply?

I looked at the list of civil surgeons that approved by USCIS. I called some of them and everyone told me differently in pricing. The basic I693 test would cost around $$220, and if i need vaccines, It would be an addition cost. Like some said the MMR vaccine would cost $120, the other said $50
Lot of them said the cost for chicken pox vaccins is around $120 ( I dont have insurance). My parent is not really sure if I ever have chicken pox or not so incase I need one, DO you know where to get those shots cheaper? Thank you for your time!
go to your county health clinic and take the vaccinations. they are usually free or very cheap. you can then show the report to the uscis doctor to get a waiver.

You can only apply for extension 6 months before exipry.. so the earliest you can do is Mar 30th. Right now, USCIS is very keen on consulting cases, and RFE for client details is pretty much the norm. I got a similar RFE for which I responded, and nothing happened for more than a month. So I applied for premium processing, and they sent another RFE again. I am still waiting on the RFE, but I think it could be because my initial contract agreement (that my company probably sent in the response for RFE) had an end date of 2/28. It is now extended till June, but that is how my client works...
My advice,
1. try not to accept to be on bench... ask your employer to pay while on bench.
2. Apply for h1 extension well before your contract ends or do premium processing if the contract ends in less than 3 months.
3. Be prepared for an RFE. Make sure you can get client letters and such
hope you won't get into what I am experiencing for the last 11 months :(

I am in the process of moving between jobs. The old job is a teaching job in a university and the new one is a research position in a non-profit think tank. So there is no H1B quota issue for both jobs.
The H1B for the old job won't expire unit next year. I have received the H1B for the new job. The start date for the new H1B is Sept. 1st.
My question is: Can I start my new job before Sept. 1st? I understand that for H1B transfer, one can start the new job once the application receipt from USCIS is received. But in my case, I have already got the new H1B and the start date on that is Sept 1st.

My husband is in the same position too.He is a fellow and got a job to start in 2008 july.lc dne.i 140 pending..
Can he file for i 485....ead for a future job...this has been in our head since this evening....cant wait till tomorrow morning to ask the lawyer:rolleyes:

I Just heard back from my Fortune 500 company that they will accept the replacement card receipt notice...so it may work. It will help to specifically ask the HR/Lawyer to check the Receipt rule.
